1. About this service

My Overtime Pay (“we”, “us”, “our”) provides general information and self-service tools to help Australian employees consider whether they may have an unpaid overtime, penalty rate, allowance, or lost-earnings issue, particularly while on light duties or workers compensation.

2. Acceptance of terms

By accessing or using this website, the calculator, the document checklist, or any submission feature, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the service.

3. Eligibility

You must be at least 18 years old and able to enter into a legally binding agreement to use this service. The service is intended for use in relation to employment in Australia.

4. User accounts and submissions

You are responsible for keeping your account credentials secure and for all activity under your account. You confirm that any information, payslips, rosters, medical certificates, or other documents you upload are yours to share, are accurate to the best of your knowledge, and do not infringe any third-party rights or confidentiality obligations.

5. Reviews, agreements and decisions

Submitting documents does not create a lawyer-client relationship and does not guarantee any outcome, payment, or referral. We may approve, decline, or request more information at our discretion. If a claim is declined, we will provide a reason and any next steps within the platform.

6. Acceptable use

  • Do not submit false, misleading, or fraudulent information.
  • Do not upload documents you are not authorised to share.
  • Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the service.
  • Do not use the service to harass any person or organisation.

7. Intellectual property

All content, branding, calculators, templates, and code on this site are owned by us or our licensors and are protected by copyright and other laws. You retain ownership of documents you upload, and grant us a limited licence to store and review them solely to provide the service to you.

8. Disclaimer

The information and tools on My Overtime Pay are general in nature and do not constitute legal, financial, taxation, industrial relations, or workers compensation advice. Calculator outputs are estimates only, based on the inputs you provide and assumptions that may not match your award, enterprise agreement, contract, or state-based scheme.

We do not guarantee that you have a valid claim, that any amount estimated is recoverable, or that any limitation period will be met. Before acting, you should verify your entitlements with the Fair Work Ombudsman, your union, your payroll team, your insurer, or a qualified Australian workplace lawyer.

To the maximum extent permitted by law, we exclude all liability for loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the service. Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Third-party links and services

The service may link to or rely on third-party websites or providers (for example, government resources or cloud infrastructure). We are not responsible for the content, availability, or practices of those third parties.

10. Termination

We may suspend or terminate your access to the service at any time if we reasonably believe you have breached these terms or misused the service. You may stop using the service at any time and request deletion of your account in accordance with our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. The “Last updated” date at the top reflects the latest version. Continued use of the service after changes are posted means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia in relation to any dispute arising from the service.
